法律哲学 Philosophy of Law

陶子谦 | Cornell University

In this course we will be discussing basically everything about law except the technical side of it. We might cover some concepts that are commonly used in the legal domain, but we won’t look at how to win cases by manipulating them, as you may be dreaming of after watching some TV shows like Suits.
This course is divided into two parts. In the first part, we will try to answer the question “What is law, and how should we interpret it”. Particularly, is law consisted of a bunch of commands issued by superiors or rules? Does law have moral content? What principles judges should follow when interpreting law? Trust me or not, we are going to fail, but it’s worth a shot. In the second part, we will deal with some problems of the application of law. Do we have an obligation to obey the law? Under what circumstances we can, or should disobey the law? What are the limits to liberty?
